Welcome to the Winbjörk Photo (the “App”). By accessing or using tWinbjörk Photo, you agree to comply with and be bound by these Terms of Use (the “Terms”). Please read these Terms carefully before using the App. If you do not agree to these Terms, please do not use the Winbjörk Photo App.
1. Acceptance of Terms
By creating an account, purchasing a subscription, or using the App in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.
2. Description of Services
The WinBjork App offers a variety of features, including:
- Mentorship: Access to mentorship content and the ability to submit mentorship requests.
- Photo Tour: Access to photo tour content and the ability to submit requests for photo tours.
- Photography Tips: Access to free and premium photography tips. Users must purchase a subscription to view premium content.
- My Camera Bag: Access to free content about camera equipment and usage.
- Blog: Access to blog posts excluding Photography Tips and My Camera Bag categories.
- Prints: Ability to view and place orders for prints listed on the App.
- Account Features: Options to register, log in, and receive push notifications.
3. Registration and Account Security
To access certain features of the App, you may be required to register and create an account. When creating your account, you agree to provide accurate and complete information, including your first name, last name, and email address.
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device. You agree to accept responsibility for all activities that occur under your account.
4. Subscriptions
- Subscription Content: Some content on the App, specifically premium photography tips, requires a subscription to access.
- Subscription Plans: Subscription plans and prices will be clearly displayed in the App. The subscription length and price will be specified at the point of purchase.
- Auto-Renewal: Subscriptions are auto-renewing unless cancelled at least 24 hours before the end of the current subscription period.
- Cancellation: You can manage your subscription and turn off auto-renewal from AppStore.
- Refunds: All subscription fees are non-refundable. In the event of a technical issue or other significant disruption, please contact us for support.
5. Payments
All payments for subscriptions are processed through the App Store (Apple). No payments are made directly within the App for the Prints section, which redirects users to the WooCommerce platform for transactions.
6. User Content and Conduct
- User Submissions: Users can submit requests on the Mentorship and Photo Tour pages. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, distribute, and display such content.
- Prohibited Conduct: You agree not to engage in any of the following prohibited activities:
- Using the App for any unlawful purpose.
- Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
- Interfering with or disrupting the App or servers or networks connected to the App.
7. Intellectual Property
All content and materials on the App, including text, graphics, logos, and images, are the property of Winbjörk Photo or its content suppliers and are protected by intellectual property laws. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the App without express written permission from us.
8. Termination
We reserve the right to terminate or suspend your account and access to the App at our sole discretion, without notice and liability, for conduct that we believe violates these Terms or is harmful to other users of the App, us, or third parties, or for any other reason.
9. Disclaimers and Limitation of Liability
The App is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the operation of the App or the information, content, or materials included on the App. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
In no event shall Winbjörk Photo be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the App, whether based on contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the App shall be resolved exclusively in the courts of Sweden.
11. Changes to Terms
We reserve the right to modify these Terms at any time. If we make changes, we will notify you by revising the “Effective Date” at the top of these Terms and, in some cases, we may provide additional notice. Your continued use of the App after the posting of changes constitutes your acceptance of such changes.
